De acuerdo con la legislación vigente aplicable, en México no existe una licencia o autorización expresa para la operación con activos virtuales. Sin embargo, dadas las últimas modificaciones a la Ley Federal para la Prevención e Identificación de Operaciones con Recursos de Procedencia Ilícita (en adelante, la “Ley”), la oferta recurrente de activos virtuales es ahora considerada como una actividad vulnerable. Transcribimos el artículo 17 de la ley, para mejor referencia:
Por ello, la normativa aplicable es la referida en esta Ley. Dentro de esta legislación, se señala que deben cumplir con ciertas obligaciones de identificación de clientes, inscripción en el registro de la Secretaría de Hacienda y Crédito Público, así como ciertos avisos a la referida Institución. Asimismo, se realizó una importante modificación respecto de las reglas generales de la citada Ley. Dichas modificaciones entraron en vigor el 30 de noviembre de 2020, y se acordó, entre otras cosas, que la actividad vulnerable descrita en el artículo 17 fracción XVI, transcrito en el párrafo anterior, deberá seguir un procedimiento distinto para su registro.
